By using abcstay.com, you acknowledge and agree that you are subject to the following Terms and Conditions. Please read these terms carefully, as they contain important information about limitations of liability and resolution of disputes though arbitration rather than court.
A user’s reservation or use of abcstay site is bound by the terms and conditions of the abcstay site where the reservation is finalized (and not necessarily the abcstay site in which the reservation is originally listed). If there are any differences between the terms of use in any other site where you found any of our properties, the terms and conditions where you finalized the booking will govern. If you do not fully agree with these Terms, you are not authorized to access or use the Site. Under these terms, “use” or “access” of the Site specifically includes any direct or indirect access or use of any information or content on the Site, regardless of how obtained and the term “Site” includes, without limitation, any cached version.
1. Proprietary Rights and Downloading of Information from the Site
This Site and all its data, including pictures, art and copy are protected by the US and, International Copyright laws and conventions and database rights. You agree to abide by these laws and all copyright notices for copying, storing, or otherwise accessing the Site or any content on our site for other than your booking or purchasing a property.
2. User’s Data
Your personal email, name, and other information, not-including credit card information, may be stored in our database for marketing purposes, once a month. You may opt out of it by sending an email to abcstay@abcstay.com with your name, email, and request to be removed. We will not disclose your information to any third parties or use your information to market to you for any other purposes than rental of furnished units or buying or selling of units.
3. User Identity and Tenant Verifications
User and Tenant Verification is important to us. We ask you to provide us with all those staying in the unit for security reasons. If you are not the person staying in the apartment, we require a written consent by email, including the prospective tenant in such communication before check-in so that we can verify the actual tenant and send him a user agreement independently of payment. He, she, or they will be liable and must follow the terms and use of this web site. Both the payer and the tenant will be responsible for following the site’s terms of use, property rules, and ID verification process.
4. Security and Property Privacy and Protection
You will not allow or, give access to persons, except your guests and the people authorized to stay in the apartment, to enter the property, unit or hallways.
You will not provide any of your information regarding the use and terms of this booking agreement to any third party regarding the amount of people who stayed in the apartment, length of stay, or number of units in the building and/or a payment invoice. If you or any of your authorized guests provide any information to anyone other than the identified employees of our company, you will be liable for costs or damages that arise from such information. You will not allow anyone other than your guests to enter the apartment, take pictures, or walk the unit for any purposes. Landlord, landlord assistants, cleaning staff or identified booking agent will be the only people authorized to enter or allow anyone to enter and/or speak with any unidentified persons if such inquiries arise. You will report any incidence where you did not allow some other persons other than your guests to come into the building or into your apartment to the Landlord or booking agent immediately.
5. Responsibility for Reviews
You have a duty to give us at least one opportunity to fix or change any issues you are having in the unit in writing. You agree that you cannot post any negative reviews about our company or apartment if you have not given us prior notice of the issue. We have 24 hours to confirm the receipt during weekdays and ask pertinent questions and 24 hours to start to issue a resolution, or 3 days if during the week-end, to respond by phone or email before you post a negative review. If you have not reported any issue, you agree you will not review us negatively.
6. Processing Fee
We charge a service fee and credit card fees for every booking. The processing fee will be displayed to you at the time of booking. This fee will not be refunded if abcstay chooses to allow a last-minute cancellation as it is used to pay for the administrative cost of bookings.
7. Credit Card Fees
Credit card fees will apply to all reservations and are a percentage of the final booking amount. If you wish to pay by transfer or bank check, we require monies be available in the account before booking is confirmed.
8. Cleaning Fees
A cleaning fee will always be charged for the end of your stay. Price depends on the size of your unit. If you have booked for more than 6 months we will give one free cleaning per month. This does not include personal laundry.
9. Cancellation
We have a strict cancellation policy. Reservations must be cancelled 60 days in advance for a full refund, excepting the processing fee. When possible we try to rent the unit again. We do not return any monies for last minute cancellations.
10. Cancellation Fee
In addition, if abcstay.com chooses to cancel a reservation requested by tenant, a cancellation fee of 20% of total booking price less processing fee. Processing fee and credit card fee will not be refunded. We will refund 100 % of monies received from 1st day of new booking.
If there a problem with a unit that is out of our control, like fire, plumbing, or other mechanical or technical issue that prohibits habitability, and abcstay is unable to find you another equivalent unit, we will return all of the monies, including processing fee. If you choose to find another unit without giving us the opportunity to replace such unit, the processing fee will not be refunded and a re-stocking fee of 10% of the security deposit will be charged. Equivalent units will be meant to say, same number of bedrooms and bathrooms, neighborhood proximity and similar amenities and service.
11. Security deposit
Security Deposit is refundable and required before entering the unit. Credit card fees apply. For stays longer than two months, the security deposit will not be returned until we have received a Con-ed bill and unless you have agreed to pay utilities separately and the bill does not exceed the agreed upon utility amount.
12. Pet Deposits
Pet deposits will be refundable and will apply once the pet is approved. The amount depends on the unit and the number and type of animals.
13. Cancellation Insurance for Travelers
You are required to have your own cancellation insurance before you book. Any cancellation not covered by your cancellation insurance will not be the responsibility of abcstay.
14. Social Media or Third Party Web site
If you liked our page and have allowed us to see your public profile, then you agree that we may use your review and public profile in connection with content in our blog or our page.
15. Translation and Maps
Translations are provided for user friendliness. We cannot be responsible for any differences in language that caused you to misunderstand a process due to nuances of language. For security reasons we provide a general idea of the building, like street and avenues, but we do not guarantee the accuracy of a map and all maps are subject to the Google’s Terms of Agreements.
16. Limitation of Liability
In no event will abcstay, officers, directors, consultants, agents, or third-party providers be liable for any loss or damage of personal property during your stay. In the event of a software malfunction or host malfunction, you agree abcstay will not be made liable for any damages or costs that such malfunction may cause. Links and pointers to other internet sites are not sponsored by us and therefore we are not liable for any liability caused by any links in our sites that cause you or the tenant of the unit any damages.
If you have a problem with any of the services of this site, you agree to contact our abcstay customer satisfaction team. We do our best to help our customers. If we are not able to solve your claims in 60 days, you may seek relief only in New York City courts. If your case involves matters that were in these Terms and Conditions that you disagree with after signing the contract, you agree to be responsible for all our legal fees.
17. Property Insurance and Traveler Liability
Users are responsible to obtain insurance for Property Liability and personal property. Although we care about user experience, we cannot be responsible for personal property. If you have suffered a break-in, you must call 311 and report it to your local precinct. You are required to provide abcstay a copy of the police report. You must lock the doors before leaving your apartment to avoid adverse situations.
18. Photographs
You agree that you will not hold this company accountable for any difference between photographs and the furnishing of apartments that you or others may have found. We try our best to keep our apartments in the best possible shape, so we change our furnishing to reflect our quality and do not always take new photos.
19. Termination of Contract
If someone is using bad language or violating our terms of agreement such as smoking, selling any illegal products, or disturbing other dwellers in building, you agree that after receiving a letter of eviction from abcstay for any of these reasons you have 2 days to leave the unit or you will lose your security deposit and be liable for all damages abcstay incurs. You also agree that you will be charged for the whole stay.
20. Conditions of Stay
No smoking in any of the units.
No parties and loud music in any of the units.
No loud music or television after 10:00 PM.
No subleasing of units or listing in platforms.
No other people can stay in the apartment which are not in the lease without prior email notification.
No use of fireplace, candles, or fire related paraphernalia.
No pets allowed unless previously approved.
No illegal web activity while using our internet services.
Check-ins after 5:00 pm incur an extra cost of $50.00.
All travelers are required to provide ticket information and email us if any emergency has prevented them from arriving on time.
The host will not wait more than one hour after check-in time has expired, unless otherwise informed of the delay.
Late Check-outs are not allowed unless previously approved.
A Late Check-Out fee will be charged if approved for those looking to stay after 11:00 AM.
A Full Day will be charged for those who check-out after 3:00 PM.
